2.1.4 General information

Additional information : The applicable law is the law of Montenegro. The works are expected to be financed through a loan from the European Investment Bank (EIB, “Bank”), a grant from the Western Balkans Investment Framework and a loan from the European Bank for Reconstruction & Development. Further information is available here. https://www.wbif.eu/investmentgrants/WB-IG09-MNE-TRA-01 The Procuring Entity intends to conduct preliminary market consultations with a view to preparing the procurement and informing economic operators of its procurement plans and requirements. The consultation shall, inter alia, be implemented through a consultation workshop to take place during the summer of 2025. Interested firms are invited to express their interest, by contacting the Procuring Entity at the address above, to be invited to such a consultation workshop event. The market consultation shall seek market views, inter alia, on the packaging of works, type of procedure, eligibility criteria, selection criteria, award criteria as well as the duration and other key conditions of the implementation of the works. Interested firms’ involvement in the market consultation shall be without prejudice to their right to apply / tender for the subsequent works. A contractor or contractors will be selected in accordance with the EIB Guide to Procurement of July 2024. Firms originating from all countries of the world will be eligible to tender. However, tenderers shall not be in conflict of interest or have been declared ineligible by the Bank. The Bank shall not provide or otherwise make funds available, directly or indirectly, to or for the benefit of an individual or entity that is (i) a designated target of, or otherwise subject to financial enacted, administered, implemented, imposed or enforced by the EU , UN , US and/or UK (‘’Sanctions’’) and (ii) in connection with the tendering process, or in the execution or supply of any works, goods or services for the Contract, has acted or will act in contravention of relevant Sanctions and/or in any manner that would result in a breach by the EIB of any Sanctions. The EIB Anti-Fraud Policy and EIB Exclusion Policy apply. Applicants/tenderers will be required, inter alia, to complete and sign a Covenant of Integrity as part of their application/tender. Failure to submit a properly completed and signed covenant may lead to rejection of an application / tender and other remedy under applicable EIB policies. During the subsequent tendering phase, the Procuring Entity reserves its right to seek clarifications and verify submitted references and use the information so obtained for evaluation purposes. All costs related to participation in future procurement procedures shall be borne by applicants/ bidders. The provisions for seeking a debriefing or submitting a complaint will be set down in the tender documentation available in due course at the address above. Potential applicants/ bidders should alert the Procuring Entity, with a copy to the European Investment Bank to procurementcomplaints@eib.org , in case they should consider that certain clauses or provisions of this notice might limit international competition or introduce an unfair advantage to some firms. Furthermore, any party having or having had an interest in obtaining a particular contract and who has been or risks being harmed by an alleged infringement of the Guide to Procurement may submit a complaint to the Bank’s Procurement Complaints Committee (PCC) as per Annex 8 of the EIB’s Guide to Procurement. 3.1.5 General information

Additional information : The works include: (i) minor realignment and replacement of the permanent way, (ii) refurbishment of structures, including Sozina tunnel, (iii) slope protection works, (iv) replacement of OHL and ETS; plus (v) modernization of signalling, thereby to bring the line substantially into compliance with European Technical Specifications for Interoperability. The tender documents will include draft conditions of contract which are expected to be FIDIC general conditions for Employer design, as amended through particular conditions. The tender documents will, inter alia, require that the selected contractor(s) perform the works in line with the provisions of an Environmental and Social Covenant to be submitted by all bidders and then incorporated into the subsequent contract signed with the selected contractor(s). Licenses from relevant Montenegrin Authorities will not required at the time of expressing interest/bid submission, but will be required for the performance of the contract in accordance with the terms of the tender document(s).
