The contracting authority deems that there is a legal right to enter into a contract without a prior competition in accordance with foa § 21-5 letter a, which allows for direct procurement when cf. Helse Vest IKT and Hemit HF intend to enter into a contract with Logex A.B. for the migration of the existing Cost Per Patient (KPP) service over to ongoing service procurements of KPP services (SaaS). Helse Vest IKT and Hemit HF intend to enter into the agreement by 1 September 2025. The contracting authority deems that there is a legal right to enter into a contract without a prior competition in accordance with PPR § 21-5 letter a, which allows for direct procurement when "competition is impossible due to technical reasons". Logex AS is the sole supplier on the basis of their services that fulfil the Contracting Authority ́s requirements (see below), and it is therefore not relevant to have a tender out of the contract, cf. FOA 13-4 b) point 2. The health companies in Helse Vest and Helse Midt-Norway with specialist health services are required periodic reports to FHI of Kostnad Per Pasient (KPP) basis, which is also used for statistics and analyses. Both health regions report on the outgoing system from Logex (Prodacapo). Prodacapo is acquired by Logex, and the system is end-of-life with agreement terms that terminate at the end of the year. Logex ́s 'new' cloud based service is, in principle, a further development of the Prodacapo system. The ICT companies operate and manage ICT systems for the Health Authorities in their respective health regions, as well as systems for the private and non-profit organisations that the ICT companies have an operational agreement with. It is intended that these will join a new contract from signing. KPP is a well regulated delivery based on FHI model, at the same time it is complicated because it requires detailed competence in the health companies' hospital operations, organisation and accounts. Competence within the accounting rules for hospitals in Norway is not transferable from other European countries without further ado. LOGEX A.B. is the only supplier in the Norwegian market who has a ready developed and documented system, has in-depth experience with effort-controlled financing and the DRG system in Norway. They can offer the relevant KPP system with a complete model for connecting clinical and economic data, including data integrations, benchmarking and local adaptations to Norwegian health data. This, together with the time factor for end-of-life, means that it is crucial for health companies to enter into a contract with a tenderer who provides system services, knowledge and tools tested in Norway with documented Norwegian KPP deliveries. Helse Vest IKT and Hemit HF have no knowledge that other suppliers than Logex have experience with delivering Norwegian KPP systems as requirements above. We perceive to have one-supplier situation.
