Justification for the duration of the framework agreement : This procedure is justified under Regulation 29(3)(a) and (b) of the 2016 Regulations on the following grounds: 1. Project Complexity (Regulation 29(3)(a) The nature of the contract involves the transitioning off an existing on premise legacy phone and voicemail system to a cloud-based alternative. The winning tenderer needs to work with all aspects of our existing ICT environment. These requirements cannot be met without adapting solutions that are not currently “off-the-shelf” and require technical input from economic operators to finalise the solution design. 2. Inability to Define Technical Requirements with Sufficient Precision (Regulation 29(3)(b)) Given the bespoke solution required, it is not possible to fully specify in advance all the technical and functional requirements needed to deliver the end solution. Engagement with shortlisted tenderers through negotiation will allow for refinement of the specification, ensuring feasibility and value for money.
