The University of Bergen (UiB), Department of Geoscience, has received funding from the Research Council of Norway for upgrading the UiB Ægir 6000 ROV system. It has been considered that the conditions for the procurement without competition are fulfilled, cf. § 13-4: "The contracting authority can hold a procurement without a competition if b. the procurement concerns services that only a specific supplier can deliver because 2. competition is impossible for technical reasons 3. The tenderer has the sole right, including intellectual property rights. Nos. 2 and 3 only apply when there are no reasonable alternatives and the lack of competition is not due to the contracting authority having adapted the procurement documents to a particular tenderer;' The procurement concerns services that only Kystdesign AS can deliver. There is a need for a total supplier who, in the choice of components and adaptations to the existing equipment and software, can plan, draw, find suitable components, adapt them, assemble and test functionality. Kystdesign has delivered the original ROV, has rights to designs and drawings and an overview of what has been previously delivered. The coastal design can quality assure that the new equipment is suitable for the existing ROV and that new components fit together. Individual components must be delivered from suppliers other than Coastal Design, but UiB does not have the competence to make assessments and specifications themselves. There is also a need for adaptations and coordination, so that there is a need for a total supplier. There are other ROV suppliers, but not of the same type of ROV. They will, therefore, not be able to cover the need. The competition is therefore impossible for technical reasons and as Kystdesign has intellectual property rights which mean that competition is not possible.
