Description : The scope of this Framework Contract includes development and delivery of the final design up to build-to-print and manufacturing specifications for the following: - Core Plasma Thomson Scattering (CPTS) Diagnostic; - Charge-eXchange Recombination Spectrometer (CXRS) Diagnostic; and - Parts of the Bolometer Diagnostic. The CPTS will inject high power laser light into the ITER plasma via a series of mirrors and windows. Other mirrors will collect small amounts of light scattered from electrons in the plasma and focus the light onto an optical fiber bundle. The fibers will bring the light to a set of spectrometers. Analysis of the spectrum will provide information on the temperature and density of the plasma electrons. Laser light not scattered by the plasma electrons will be collected by a beam dump inside the ITER vessel. The CXRS will collect, via a series of mirrors, light emitted by charge-exchange processes as a beam of energetic neutral particles crosses the ITER plasma. As for the CPTS, lenses will focus the light onto an optical fiber bundle that will bring the light to a set of spectrometers. Analysis of the spectrum will provide information on ion temperature, rotation velocity and impurity concentrations in the plasma. The Bolometer Diagnostic will use a set of sensors distributed around the ITER plasma to provide information on the total radiated power in a wavelength range from infrared to soft X-ray. Bolometer cameras within the scope of this framework contract are metal structures with internal ceramic parts that house the sensors, collimate light from the plasma to provide spatially resolved information and provide electrical connections from the sensors to cabling.

Reason for modification : Need for additional works, services or supplies by the original contractor.
Description : The services by the original contractor that are the subject of this amendment where not included in the original procurement and have now become necessary. A change in contractor is not possible due to the new tasks being fully connected with the work already (being) performed and any change would be highly inconvenient for F4E (this path would introduce substantial delays (9 months to 12 months)) and represent a very high additional cost (estimate a minimum 20% increase in direct costs). Bringing a new contractor to the project to implement the scope defined in this DNO would require a transition process, particularly on some technical know‐how accumulated during the execution of the current contract. This learning curve would induce significant delays and non negligible efforts on the F4E team, generating a major disruption to the recently regained operational momentum and having severe impact in the global project schedule. Regardless of meeting the conditions for an amendment (Article 89f.4a of F4E Financial Regulation), any potential re‐tendering for services related to CXRS would anyway had a form of another specific contract concluded with the Contractor or an amendment to an existing one. The re‐tendering would have to follow Article I.4.10 b) of the Framework Contract, which stipulates that any other specific contract related to CXRS would be awarded on the basis of the cascade, with the Contractor – who won a mini‐competition for CXRS – the first contractor in cascade. Placing the scope of the amendment under a separate new contract would also increase the risk of weakening the coherence of the work performed vs the work being performed under the same contract. The scope of the amendment does not alter the subject matter of the Specific Contract ﴾and falls into the CXRS‐related services that are awarded to the Contractor through a cascade established under the Framework Contract﴿. The additional work does not represent 50% of the value of the original contract.

7.1.1 Change

Description of modifications : Specific Contract F4E‐OMF‐0847‐02‐01 is hereby amended as follows: - The value of the contract has been increased to EUR 6,860,664.97; - Travel and subsistence expenses may be reimbursed. Pursuant to Article I.5.5 of the Contract, the maximum amount of the lump sum for travel and subsistence expenses is EUR 49,985.50. Payment of the lump sum shall be adjusted to the extent that the Mission has not been executed according to the Specific Contract; - Fusion for Energy shall pay the Contractor a pre‐financing payment of EUR 1,203,251.59 (the "Pre‐financing Payment") in accordance with Article I.7.1 of the Contract. - Additional works included in Appendix I (Task Description) of the Specific Contract; All other articles remain unchanged.
