Justification for direct award : The contract can be provided only by a particular economic operator because of exclusive rights, including intellectual property rights
Other justification : • Lack of real alternatives: Kongsberg has developed its system and no other suppliers offer an identical system with the same performance, security and functionality. HI requires a system that can very easily be integrated with other navigation and sensor systems (such as inertia navigation system (INS), echo sounder etc.) that are on board HI's many vessels. HI shall retain the rights to further develop this system in order to meet specific needs (e.g. whale counting and articulation). . • Exclusive supplier: Kongsberg sells its system directly without distributors in Norway. See the attached 'Confirmation Letter'. .
