Justification for direct award : The contract can be provided only by a particular economic operator because of an absence of competition for technical reasons
Other justification : Dublin City Council is relying on Article 32.2.(b)(ii) in this instance. The Ringsend Irishtown Local Environment Improvement Plan (LEIP) had been adopted at the June 2017, South East Area Committee Meeting. Following extensive local consultation, it was identified that the redevelopment of Library Square comprising the refurbishment of the library and the improvement of the public realm was the priority project from the LEIP to be progressed. Following a procurement process using the City Council’s Panel of Landscape Architects and approval under Manager ‘s Order No. OCE SEA 01/18 a contract was awarded to a design team, led by Mitchell & Associates, to advance the Library Square Project in Ringsend by the preparation and submission of a draft Part 8 planning application. Additional requirements were identified during the preparation of the draft Part 8 and, following a further procurement process using the City Council’s Panel of Landscape Architects, Order No. OCE SEA 01/21 appointed a design team, led by Mitchell and Associates, to take forward the draft planning application to Part 8 approval in view of funding availability under the Urban Regeneration Development Fund. The Part 8 Planning for the redevelopment of Library Square was presented to the South East Area Committee in November 2023 and was approved by Dublin City Council on the 8th April 2024. Subsequent to planning approval, a programme of site investigations was undertaken by Roughan & O’Donovan, following a tendering process. This programme took 6 months and uncovered a highly complex underground service environment. This necessitated in-depth discussions between the Roughan & O’Donovan and Eirgrid/ESB and consideration of decisions on decommissioning of services, which could only be made by asset owners. These issues were resolved in July of 2025. Considerable preliminary design work and site investigations have been completed by Roughan & O’Donovan, including inter alia, redesign of the road width and realignment, removal of the eastern super-elevation and design of a raised table-controlled crossing, as well as development of an outline 3D model. Roughan & O’Donovan possess exclusive, unrecorded knowledge relating to site investigations and status of underground services, and preliminary design strategy. In addition, the outline 3D model contains embedded data directly informed by the interpretation of site investigations. Appointment of a new firm would result in duplication of this work as a new consultant would be unable to safely assume responsibility for the preliminary design and would require re-verification and re-interpretation of the site investigation data and reports. Dublin City Council gives notice to lawfully invoke Article 32. 2 (b)(ii) of Directive 2014/24/EU for a derogation from tendering for detailed design for the redevelopment of Library Square due to technical reasons stemming from the necessity of retaining Roughan & O’Donovan. It is proposed that the previously appointed design team members, with Roughan and O’Donovan now acting as lead, be appointed. This action is justified as the services can only be supplied by this particular economic operator for technical reasons and to avoid substantial duplication of cost and delay that is unacceptable to the project schedule and the requirements for full draw-down of URDF funding by 2030.
