The current supplier, UTS Technologies Ltd. owns the installed machines and is the only party capable of maintaining, operating and supporting them during this interim period. This direct award is necessary to ensure the continued delivery of critical public services while a full procurement process is conducted for a new long-term contract. That procurement process is expected to take approximately 12 months to complete, including planning, tendering, evaluation and implementation. Justification for direct award : The contract can be provided only by a particular economic operator because of an absence of competition for technical reasons
Other justification : This direct award is being made under Article 32.2 (b) (ii) of Directive 2014/24/EU: "where the works, supplies or services can be supplied only by a particular economic operator for the following reasons (ii) competition is absent for technical reasons." In this case, the installed on-street parking Pay & Display ticket machines are the property of the current provider, UTS Technologies Ltd.. Only the supplier has the proprietary knowledge, tools and access rights required to maintain and operate the existing equipment. No other supplier can practically deliver the service in the interim without significant cost, delay and operational risk to the Council. A full procurement process is currently being developed and will be published to secure a new long-term contract. This direct award is strictly time-limited to cover the interim period and ensure the uninterrupted delivery of critical public services. The direct award will include an initial 12-month period with the option to extend by two further 3-month periods if necessary to allow completion and mobilisation of the new contract.
