2.1.4 General information

Additional information : The Utilities Regulations § 17-5 give the contracting authority the opportunity to "enter into a contract without announcing the competition" if the contracting authority "believes that he has the legal right" to do so. If the procurement concerns services that only a particular supplier can deliver because "competition is impossible for technical reasons", the procurement can be carried out without a competition, cf. § 9-3 letter b no. 2. The terms require that it is technically impossible for others to provide the relevant service. In this case, only Salsnes Filter AS produces the filters as well as the spare parts of the filters used in the relevant treatment facilities. It will be technically impossible for other tenderers to carry out service on filters and parts that Salsnes has produced. The contracting authority therefore considers that the condition for entering into a contract without announcing the competition has been met.
