Need for modifications because of circumstances which a diligent buyer could not predict.
Description
:
The need for modification arises from the evolving technical requirements of the JT-60SA project. A strategic decision was made by the Broader Approach Steering Committee (BASC) to accelerate the transition from carbon-based plasma-facing components (PFCs) to tungsten-based PFCs, which better reflect ITER’s operational environment. At the time of contract signature, the exclusive use of graphite-based mock-ups was planned and budgeted. The requirement to switch to tungsten monoblock mock-ups only emerged as a result of recent project-level reviews and strategic alignment with ITER’s material approach. These circumstances described above could not reasonably have been foreseen by F4E based on the best available information at the time, and acting in a diligent manner. F4E also considers it beneficial for the Project to assume direct responsibility for procuring the tungsten raw material required for Stage 2. Above all, F4E obligations toward our Japanese counterpart require F4E to closely oversee both the procurement process and the quality of the tungsten. The tungsten needed for the prototypes in Stage 1, however, will remain under the Supplier’s responsibility. The removal of the original raw material (graphite) from the scope of Stage 2 is considered a non-substantial modification in accordance with Article 89f.4.d. The value of the removed material accounts for only 7% of the initial contract value. Furthermore, the participants and the outcome of the procurement procedure would not have been affected if this modification had been included in the original procedure. Hence, it is neither considered a significant change to the scope of the initial contract nor has any contractor been substituted. The economic balance of the contract also remains unchanged.
7.1.1 Change
Description of modifications
:
The proposed modification — which includes increasing the number of mock-ups from 12 to 18 and switching the design and material from graphite flat tiles to tungsten monoblocks — will result in a cost increase of 49.9% of the initial contract value. This remains within the 50% ceiling stipulated in the regulation. With this modification, the original contract, amounting to a total value of EUR 9,976,500.00 (EUR 654,500.00 for Stage 1 + EUR 9,322,000.00 for Stage 2) will be increased by EUR 4,988,250.00 (EUR 448,900.00 for Stage 1 + EUR 4,539,350.00 for Stage 2) resulting in an amended total value of EUR 14,964,750.00 (EUR 1,103,400.00 for Stage 1 + EUR 13,861,350.00 for Stage 2).
