Justification for direct award : The contract can be provided only by a particular economic operator because of an absence of competition for technical reasons
Other justification : Respirators are classified as life-maintaining medical-technical equipment. The use of such equipment requires a high degree of precision, quick response and in-depth competence of health personnel - especially in acute and complex treatment situations. The standardisation of equipment is therefore seen as decisive for safeguarding patient safety. The department currently uses five (5) Hamilton C6 respirators, procured in 2020/2021. The procurement of respirators with different functionality or user interface will result in a significant need for training of doctors, nurses and medical-technical personnel. Given the current high clinical load and limited resources, this is considered to be both unrealistic and disproportionately demanding. Disadvantages of procurement from another supplier: • Comprehensive and recurring training need for approx. 65 nurses and a 20s doctors. • Need for separate storage of consumables and spare parts • Increased complexity in operation and maintenance. • Risk of loss of technical competence if one unit deviates from the rest of the equipment • Complete replacement of existing equipment is seen as economic and operative unrealistic. Requirements for the equipment that shall be procured: • Must be identical to the existing Hamilton C6 respirators in order to enable safe and immediate use without need for further training. • Shall use the same consumables and spare parts as the existing equipment. • Shall have a minimal training need for both clinical and technical personnel. • Must be able to be accommodated in the existing equipment without a need for uniform replacement. Conclusion: Based on the medical, technical and operational considerations accounted for above, it is considered to be only one supplier who can offer equipment that fully fulfils the requirements for functionality, compatibility and safe operation. There are, therefore, technical reasons why the competition cannot be held. The terms for exemptions from the competition obligation in accordance with the public procurement regulations § 13-4 first section letter b no. 2 are deemed to be fulfilled.
