Description
:
This call off contract for the upgrading of New Doolough WTP, Ballymacraven WTP and Corofin WTP, and installing a new rising main and high lift pump station to supplement Old Doolough WTP (the “Project”) was awarded in 2020 under the framework agreement reference 16/030_121. Additional works for a contract value falling within the Regulations regime were required in 2023. Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU. The additional works for the Project do not alter the overall nature of the call off contract (nor that of the framework agreement) and have become necessary, where the change of contractor for the Project at this stage would have caused: (1) technical difficulties in relation to the interoperability of the upgrading works and to change contractor now would result in additional costs and prolongation of the overall project completion; (2) inevitable cross-liabilities and warranty issues between the current contractor and a different contractor for the additional works (3) significant inconvenience due to the existing contractor currently working on the relevant sites as part of the project completion; and (4) substantial duplication of costs (e.g. mobilisation).
