Sykehusinnkjøp HF and the health companies therefore consider that there are no other suppliers than those who participated in the market dialogue who are able to provide the services and products necessary for this delivery. Helse Stavanger HF therefore intends to enter into a direct contract with Oneco Technologies AS for the procurement of services and materials for central operational installations/building automation. Other justification : Sykehusinnkjøp HF carried out at the end of 2024, on behalf of Helse Stavanger HF and Helse Førde HF, a market dialogue on the provision of services and materials connected to the service and operation of central operational facilities at the respective health authorities. The dialogue was divided into two sub areas, one for each company. The systems at both health companies were described and written feedback was requested from suppliers who could confirm their ability to provide services in accordance with the requirements specified in the market dialogue. A total of two (2) responses were received by the deadline, from two (2) different tenderers, one response per sub-area. Sykehusinnkjøp HF and the health companies therefore consider that there are no other suppliers than those who participated in the market dialogue who are able to provide the services and products necessary for this delivery. Helse Stavanger HF uses a central operational system (Central Processing System) based on Intouch with integrations with PLS systems. The system constitutes critical infrastructure for building operation and the tenderer has developed in-depth knowledge and special competence in their respective systems for several years. The existing tenderer for Helse Stavanger HF has both technical competence, specific tools and rights that are necessary to ensure continual operation, maintenance and further development of the systems in question. It is therefore considered technically impossible or disproportionately difficult for other tenderers to join the contract without extensive re-programming, system integrations and the risk of interruption to operations. This also applies due to requirements for local presence and a short response time, which means that suppliers outside the region are in practice not considered real alternatives. The costs associated with a supplier exchange will mean that only the current supplier will be able to deliver a competitive tender and that the costs and risk of operational interruptions associated with switching suppliers do not appear as a reasonable alternative. It is considered that there is some competence in the relevant systems elsewhere in Norway and internationally. Nevertheless, these tenderers must carry out comprehensive technical adaptations and training in order to achieve the necessary system knowledge and local availability/knowledge. This means that it is not considered realistic to achieve real competition through an announcement, as there are no reasonable or appropriate alternatives to the existing suppliers. Based on this, the terms for exemptions from competitions in accordance with the procurement regulations § 13-4 letters b points 2 and 3 are fulfilled, as, due to technical reasons and possession of specific rights and tools, real competitions cannot be achieved without inflicting disproportionate replacement costs and risks on the health companies.
