The most essential feature of the new MLS is to provide the Royal Danish Navy with Link 16, JREAP-C, and Link 22 capabilities, thereby enabling cooperation both within the Royal Danish Navy and with coalition partners. These capabilities will support communication in both Line of Sight and Beyond Line of Sight scenarios. Furthermore, current operational requirements necessitate achieving a limited level of interoperability with national and coalition forces as a matter of urgency, ahead of full MLS integration, hence only suppliers which previous have delivered link22 to other comparable navies have been preferred. The MLS will be installed on 12 ships over the duration of the contract, which is expected to run for 30 years. To safeguard Denmark’s essential security interests, the procedure has been conducted pursuant to Article 346(1)(b) of the Treaty on the Functioning of the European Union (TFEU) and is therefore exempt from the general EU public procurement rules. Based on the above, the Danish Ministry of Defence Acquisition and Logistics Organisation (DALO) intends to conclude a contract with Tecnobit for the acquisition of the Multi-Link Processor (MLP), including support for sustainment and training.

Additional information : DALO wishes to enter into an agreement with Tecnobit concerning the acquisition of 13 Multi Link Processors (MLP), including support for sustainment and training. Accordingly, as of now, no contract concerning the acquisition of Multi Link Processor (MLP) has been awarded to the company. The "date of the decision of choosing the winner" stated in the "Contract information" section refers to the date on which the decision was made to initiate direct negotiations with Tecnobit. It does not represent the date of contract conclusion. It should be noted that the contract includes an contract for the acquisition of Multi Link Processor (MLP) and a framework agreement for the sustainment of the Multi Link Processor (MLP). The "Duration period" stated in the "Duration" section refers to the duration period of the framework agreement, and the "Maximum renewals" states the maximum number of possible renewals for the framework agreement. In regards to the contract, the contract will remain in force until all deliveries have been completed. The field concerning whether the acquisition is a framework agreement is marked as "No framework agreement" However, a framework agreement is included in the contract. However, the framework agreement constitutes only a part of the overall acquisition, which is why the field has been completed with "No framework agreement." Other justification : It is DALO's assessment that the contract can be awarded — without a tender procedure — on the basis of essential security interests, pursuant to Article 346(1)(b) of the Treaty on the Functioning of the European Union (TFEU). The justification for awarding the contract under TFEU Article 346(1)(b) is primarily that a public tender procedure would not be able to meet the urgent and time-critical operational needs currently facing the Royal Danish Navy. This must be seen in the context of the escalating activity, particularly in the Baltic Sea, which makes it crucial for Denmark to be able to exchange combat information between Danish ships and aircraft, as well as with units from other NATO countries operating in the area. A rapid acquisition is therefore of great importance to Danish combat capability. Therefore, DALO's assessment is, that the procurement cannot be carried out effectively through an EU tender. Instead, DALO has decided to carry out a competition process pursuant to Article 346(1)(b) of the Treaty on the Functioning of the EU (“TFEU”), which entitles DALO to decide on exemptions from standard procurement rules when deemed necessary for the protection of Denmark’s essential security interests, and when the subject of the competition, as in this case, concerns weapons, ammunition, and military equipment. Hence, a limited competition has been conducted between two suppliers. The result is that DALO wishes to enter into an agreement with Tecnobit concerning the acquisition of 13 Multi-Link Processors (MLPs), including support for sustainment and training.
