The contract involves the provision of support services relating to Software and Service Support for the Dublin City Council Confirm Enterprise Transportation Asset Management System (TAMS). The Confirm Software is a proprietary system which Brightly Software Ltd own and hold the Intellectual Property Rights for. The provision of an enterprise asset management system for Dublin City Council was subject of a tender process in 2014 and the Confirm system was implemented by the successful tenderer at that time. Dublin City Council intends to award the contract to cover the software licence period 2025 with the option to extend by 12 months to end of 2026 at a value of €615,000.

Description : The following Software and Support Services shall be provided by Brightly Software Ltd. for the Dublin City Council Confirm Enterprise Confirm Transportation Asset Management System (TAMS): 1) Access to the latest Confirm application version and releases; 2) Remote diagnosis of Incidents; 3) The provision of workarounds to Bugs and Errors; 4) The provision of fixes for Bugs and Errors; 5) The provision of Functional Releases and Maintenance Releases; 6) Support for Confirm Host, Confirm Web and ConfirmConnect. 7) Support for developed components – customisations, reports and integration points insofar as those components were developed by Brightly Software Ltd. as part of the implementation of The Confirm TAMS System and/or as a result of development under previous support contracts. 8) The provision of monthly service reports 9) Confirm Upgrades shall be undertaken periodically and at not greater than two yearly intervals. The upgrade may require input from other third parties supporting DCC IS Department with other IS applications and infrastructure and Brightly Software Ltd. shall co-operate and work with these third parties as required to facilitate the successful upgrade of the Confirm System. Support shall extend to cover dealing with and resolving any issues that may be identified as a result of testing of the application following upgrade to the latest version of Confirm. 10) The provision of other support services as may be required from time to time to support DCC with development projects relating to the expansion of The Confirm TAMS System within the Departments and Sections of DCC, integrations with other DCC information systems and also to support improvements and changes to existing functionality within existing modules and user groups and also a range of other IS supported related services, where expertise is available, to support the Confirm application and infrastructure.

Other justification : Dublin City Council proposes to invoke Article 32.2(b) of Directive 2014/24/EU which states that the negotiated procedure without prior publication may be used where the works, supplies or services can only be supplied by a particular economic operator for the following reasons (ii) competition is absent for technical reasons, and (iii) the protection of exclusive rights, including intellectual property rights. Dublin City Council intends to directly award a contract to Brightly Software Ltd. for ongoing software and service support of the Dublin City Council Confirm Enterprise Transportation Asset Management System to cover the software licence period 2025, with the option for Dublin City Council to extend by 12 months to end of 2026, until such time as a review of the longer-term support needs for the system can be considered. As Brightly Software Ltd. have developed the application and own the Intellectual Property rights, they are the only company that have the technical knowledge and skills to provide software and service support for the Dublin City Council Confirm Enterprise Transportation Asset Management System. Failure to award such contract would put the continued use of the Confirm software at risk resulting in the management of Dublin City Council’s Transportation Assets in the Environment and Transportation Department being affected and key services being unable to operate.
