The Service performs among other statutory duties the payment of salaries to Members of the Houses of the Irish National Parliament and their staff as well as the payment of salaries to the Service’s own staff and the payment of statutory pensions to former Members and former staff. The payroll software the supply of which is the subject of this Notice can only be provided by one economic operator, Access, because competition is absent for the technical reasons set out herein. Transition to an alternative system lacking the existing technical interoperability and bespoke functionalities of the Access payroll software would introduce an unacceptable level of risk to the Service’s core payroll processing, and, in particular, potential for significant delays in salary payments, erroneous calculations, and a complete disruption of critical reporting functions essential for pension administration and financial oversight. The pension arrangements are governed by Irish legislation and impose specific irreducible duties on the Service. The Service performs these duties by means of a bespoke reporting software system provided by a third¬party provider, which system maintains a direct link to the payroll databases provided by Access. This highly customised system is absolutely essential for payroll reporting and generating the complex pension calculations mandated by the statutory pensions scheme. This specific interoperability requirement with the third-party system and its bespoke pension calculation logic mean that, as contemplated by Recital 50 to Directive 2014/24/EU, substituting a new payroll system – and potentially a different reporting tool – for this intricate, complex calculation, would in essence be technically impossible. Any disruption or error in this process would severely prejudice pension administration, potentially leading to significant financial and reputational repercussions. Moreover, the Service has also recently installed a new financial management system with which the Access payroll software has been successfully integrated. Requiring this financial management system to be decoupled would carry significant risks of data integrity errors, as well as requiring wholly disproportionate substitute customisation, and concomitant commitment of time and resources for rigorous testing and phased implementation across all affected departments.
