Justification for direct award : The contract can be provided only by a particular economic operator because of an absence of competition for technical reasons
Other justification : The Contracting Entity requires a circa 4km large (c. 2.1m) diameter PE100 HDPE pipeline in continuously extruded lengths of typically 500m. Alternative solutions (involving shorter length pipeline) have been discounted on account of the increased risks such pipelines would pose by reason of potential leakage and increased repair and maintenance requirements. // The required pipeline has a limited number of manufacturers. In addition, there are seasonal constraints associated with the installation of the pipeline which requires that delivery occurs at specific timeframes. // A Request for Information was published in the OJEU to confirm the availability of suppliers capable of providing this pipeline to Ireland. Only one manufacturer (Pipelife AS) confirmed that it could manufacturer and supply this pipeline directly. This aligns with the Contracting Entity’s additional market research which indicated that there are no other European-based manufacturers of the pipeline. In addition, technical advice has confirmed that the supply of the pipeline from non-European manufacturers is not practicable due to geographical constraints. // This VEAT notice is in respect of the reservation slot agreement only as it is intended that the pipeline supply contract will be included in the main contract for the GDD Project.
